Many of the independent agencies operate as miniature versions of the tripartite federal government, with the authority to "legislate" through rulemaking; see Federal Register and Code of Federal Regulations, "adjudicate" through administrative hearings, and to "execute" administrative goals through agency enforcement personnel.

While administrative decision making bodies are often controlled by larger governmental units, their decisions could be reviewed by a court of general jurisdiction under some principle of judicial review based upon due process United States or fundamental justice Canada. Judicial review of administrative decisions is different from an administrative appeal. When sitting in review of a decision, the Court will only look at the method in which the decision was arrived at, whereas in an administrative appeal the correctness of the decision itself will be examined, usually by a higher body in the agency. This difference is vital in appreciating administrative law in common law countries. The scope of judicial review may be limited to certain questions of fairness, or whether the administrative action is ultra vires.

Malice in second degree murder may be implied from a death due to the reckless lack of concern for the life of others such as firing a gun into a crowd or bashing someone with any deadly weapon. Depending on the circumstances and state laws, murder in the first or second degree may be chargeable to a person who did not actually kill, but was involved in a crime with a partner who actually did the killing or someone died as the result of the crime. Example: In a liquor store stick up in which the clerk shoots back at the hold up man and kills a bystander, the armed robber can be convicted of at least second degree murder. A charge of murder requires that the victim must die within a year of the attack. Death of an unborn child who is "quick" fetus is moving can be murder, provided there was premeditation, malice and no legal authority. Thus, abortion is not murder under the law.
